AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

This legislation creates the Padre Island Gateway Municipal Management District (district), a special law district created under Section 59 (Conservation and development of natural Resources and Parks and recreational Facilities; Conservation and Reclamation Districts), Article XVI (General Provisions), Texas Constitution, and located wholly within the corporate limits of the City of Corpus Christi.

           

S.B. 2550 authorizes the financing and development of public infrastructure improvements that are needed to accommodate residential and commercial growth and development that is expected to occur along the Packery Channel in Corpus Christi near the north end of Padre Island.  This bill enables the financing of necessary public improvements, such as streets, water, drainage, beach, park, and recreational facilities, by permitting the levy of taxes and/or assessments solely on property located within the district and without imposing any of the capital costs on the taxpayers of the city who are located outside the boundaries of the district.

 

S.B. 2550 relates to the creation of the district and provides authority to impose a tax and issue bonds.  The bill prohibits the district from exercising the power of eminent domain.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3869, as follows:

 

CHAPTER 3869.  PADRE ISLAND GATEWAY MUNICIPAL MANAGEMENT DISTRICT

 

Sets forth standard language for the creation of the Padre Island Gateway Municipal Management District (district) in the City of Corpus Christi (city).  Sets forth standards, procedures, requirements, and criteria for:

 

Creation, purpose, and approval of the district (Sections 3869.001-3869.050);

 

Size, composition, appointment, compensation, and terms of the board of directors of the district, including the naming of the initial directors (Sections 3869.051-3869.100);

 

Powers and duties of the district (Sections 3869.101-3869.150);

 

General financial provisions and authority to impose a tax and issue bonds and obligations for the district (Sections 3869.151-3869.200); and

 

Dissolution of the district by the city (Sections 3869.201-3869.203).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2009.
