BACKGROUND AND PURPOSE

 

S.B. 2576 relates to the authority of a commissioner of the Texas Workforce Commission under the law establishing guidelines regarding the functions of the commission and staff.

 

S.B. 2576 clarifies that a commissioner of the Texas Workforce Commission can legally respond to questions, take a position, offer advice, and present an opinion about issues confronting or affecting the commission. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

S.B. 2576 amends the Labor Code to authorize a member of the Texas Workforce Commission to take a position on issues regulated by, or affecting the operation of, the commission.  The bill authorizes a member of the commission to present the member's opinion or give advice regarding such an issue to a legislative committee or a member of the legislature.

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
