AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

This legislation clarifies that the Texas Workforce Commission (TWC) can legally respond to questions, take a position, offer advice, and present an opinion about issues confronting or affecting the agency. 

 

As proposed,  S.B. 2576 relates to the authority of a commissioner of TWC. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 301.0015, Labor Code, by adding Subsection (e), to authorize a member of the Texas Workforce Commission (TWC), notwithstanding Subsections (a) (relating to requiring TWC to limit its activities in administering its functions under this title or another law), (b) (relating to authorizing TWC to conduct certain activities only when acting as a governmental body), (c) (relating to authorizing TWC or an individual member of TWC to conduct certain activities), and (d) (relating to prohibiting TWC or an individual member of TWC from directing operations and establishing implementation) or any other law, to take a position on issues regulated by, or affecting the operation of, TWC.  Authorizes a member of TWC to present the member's opinion or give advice regarding such an issue to a legislative committee or a member of the legislature. 

 

SECTION 2.  Effective date:  upon passage or September 1, 2009.
