A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the application of certain contract management laws to |
|
|
the Texas Department of Transportation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2262.002, Government Code, is amended to |
|
|
read as follows: |
|
|
Sec. 2262.002. EXEMPTIONS. [(a)] This chapter does not |
|
|
apply to an institution of higher education as defined by Section |
|
|
61.003, Education Code. |
|
|
[(b)
This chapter does not apply to contracts of the Texas
|
|
|
Department of Transportation that:
|
|
|
[(1)
relate to highway construction or highway
|
|
|
engineering; or
|
|
|
[(2)
are subject to Section 201.112, Transportation
|
|
|
Code.] |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a contract by the Texas Department of Transportation for which |
|
|
the solicitation of bids or proposals or similar expressions of |
|
|
interest is published on or after September 1, 2009. A contract for |
|
|
which the solicitation of bids or proposals or similar expressions |
|
|
of interest is published before September 1, 2009, is governed by |
|
|
the law in effect on the date the Texas Department of Transportation |
|
|
first publishes the solicitation of bids or proposals or similar |
|
|
expressions of interest, and the former law is continued in effect |
|
|
for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
