A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the participation of certain metropolitan planning |
|
|
organization policy board members in votes of the board related to |
|
|
certain toll projects. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 371, Transportation Code, |
|
|
as added by Chapter 103 (H.B. 570), Acts of the 80th Legislature, |
|
|
Regular Session, 2007, is amended by adding Section 371.002 to read |
|
|
as follows: |
|
|
Sec. 371.002. METROPOLITAN PLANNING ORGANIZATION APPROVAL |
|
|
OF TOLL PROJECTS. A member of the policy board of a metropolitan |
|
|
planning organization may not participate in a vote of the board to |
|
|
approve the construction of a new toll project or the conversion of |
|
|
a nontolled project to a toll project unless the member is an |
|
|
elected official. |
|
|
SECTION 2. Subchapter A, Chapter 372, Transportation Code, |
|
|
is amended by adding Section 372.002 to read as follows: |
|
|
Sec. 372.002. METROPOLITAN PLANNING ORGANIZATION APPROVAL |
|
|
OF TOLL PROJECTS. A member of the policy board of a metropolitan |
|
|
planning organization may not participate in a vote of the board to |
|
|

|

|
SECTION 3. (a) Section 1 of this Act takes effect only if |
|
|
the Act of the 81st Legislature, Regular Session, 2009, relating to |
|
|
nonsubstantive additions to and corrections in existing codes does |
|
|
not become law. If the Act of the 81st Legislature, Regular |
|
|
Session, 2009, relating to nonsubstantive additions to and |
|
|
corrections in existing codes becomes law, Section 1 of this Act has |
|
|
no effect. |
|
|
(b) Section 2 of this Act takes effect only if the Act of the |
|
|
81st Legislature, Regular Session, 2009, relating to |
|
|
nonsubstantive additions to and corrections in existing codes |
|
|
becomes law. If the Act of the 81st Legislature, Regular Session, |
|
|
2009, relating to nonsubstantive additions to and corrections in |
|
|
existing codes does not become law, Section 2 of this Act has no |
|
|
effect. |
|
|
SECTION 4. This Act takes effect September 1, 2009. |
