A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to allowing a county to hold a nonbinding referendum on a |
|
county fiscal matter. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter Z, Chapter 130, Local Government |
|
Code, is amended by adding Section 130.910 to read as follows: |
|
Sec. 130.910. NONBINDING REFERENDUM ON COUNTY FISCAL |
|
MATTER. (a) The commissioners court of a county may hold a |
|
nonbinding referendum in the county on any question affecting a |
|
county fiscal matter other than a matter involving: |
|
(1) a labor agreement; or |
|
(2) compensation of any county employee. |
|
(b) The referendum shall be held in the same manner as an |
|
election on a county measure and must take place on an election date |
|
authorized by Section 41.001, Election Code. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
