A BILL TO BE ENTITLED
 
AN ACT
  relating to a modified instructional calendar for public high
  schools providing an early college education program.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 25.081(a), Education Code, is amended to
  read as follows:
         (a)  Except as authorized under Subsection (b) of this
  section, Section 25.084, [or] Section 29.0821, or Section
  29.908(e), for each school year each school district must operate
  so that the district provides for at least 180 days of instruction
  for students.
         SECTION 2.  Section 25.0811(a), Education Code, is amended
  to read as follows:
         (a)  A school district may not begin instruction for students
  for a school year before the fourth Monday in August unless:
               (1)  the district operates a year-round system under
  Section 25.084; or
               (2)  the district is authorized to modify the
  instructional calendar as provided by Section 29.908(e).
         SECTION 3.  Section 29.908, Education Code, is amended by
  adding Subsection (e) to read as follows:
         (e)  A school district may allow a district high school that
  provides an early college education program under this section to
  modify the instructional calendar of the high school as necessary
  to conform with the calendar of a college, university, or technical
  school with which the high school has entered into an articulation
  agreement as provided by Subsections (b)(3) and (b-1). The
  commissioner shall adopt rules to administer this subsection.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
