A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the effect of a peace officer's determination of |
|
|
financial responsibility for a motor vehicle through use of the |
|
|
motor vehicle financial responsibility verification program. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 601.053, Transportation Code, is amended |
|
|
by amending Subsection (b) and adding Subsection (c) to read as |
|
|
follows: |
|
|
(b) Except as provided by Subsection (c), an [An] operator |
|
|
who does not exhibit evidence of financial responsibility under |
|
|
Subsection (a) is presumed to have operated the vehicle in |
|
|
violation of Section 601.051. |
|
|
(c) Subsection (b) does not apply if the peace officer |
|
|
determines through use of the verification program established |
|
|
under Subchapter N that financial responsibility has been |
|
|
established for the vehicle. |
|
|
SECTION 2. Subchapter N, Chapter 601, Transportation Code, |
|
|
as added by Chapter 1325 (H.B. 3588), Acts of the 78th Legislature, |
|
|
Regular Session, 2003, is repealed. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
