A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the appointment of members to the governing body of a |
|
|
political subdivision. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 180.005, Local Government Code, is |
|
|
amended by amending Subsections (b) and (c) and adding Subsection |
|
|
(d) to read as follows: |
|
|
(b) An appointment to the governing body of a local |
|
|
government shall [be made as required by the law applicable to that
|
|
|
local government and may] be made with the intent to ensure that the |
|
|
governing body is representative of the constituency served by the |
|
|
governing body. |
|
|
(c) A local government [that chooses to implement
|
|
|
Subsection (b)] shall adopt procedures for the implementation of |
|
|
Subsection (b). |
|
|
(d) This section does not apply to an appointment to the |
|
|
governing body of a local government made by the governor. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
