A BILL TO BE ENTITLED
 
AN ACT
  relating to the appointment of members to the governing body of a
  political subdivision.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 180.005, Local Government Code, is
  amended by amending Subsections (b) and (c) and adding Subsection
  (d) to read as follows:
         (b)  An appointment to the governing body of a local
  government shall [be made as required by the law applicable to that
  local government and may] be made with the intent to ensure that the
  governing body is representative of the constituency served by the
  governing body.
         (c)  A local government [that chooses to implement
  Subsection (b)] shall adopt procedures for the implementation of
  Subsection (b).
         (d)  This section does not apply to an appointment to the
  governing body of a local government made by the governor.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
