A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the prevention of racial profiling by certain civilian |
|
|
employees of the Department of Public Safety. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 2.131, Code of Criminal Procedure, is |
|
|
amended to read as follows: |
|
|
Art. 2.131. RACIAL PROFILING PROHIBITED. (a) A peace |
|
|
officer may not engage in racial profiling. |
|
|
(b) A civilian employee of the Department of Public Safety |
|
|
assigned to a driver's license facility of that department may not |
|
|
engage in racial profiling in issuing an original, renewal, or |
|
|
duplicate driver's license, commercial driver's license, or |
|
|
personal identification certificate. |
|
|
SECTION 2. Article 2.132, Code of Criminal Procedure, is |
|
|
amended by adding Subsection (g) to read as follows: |
|
|
(g) To the extent that they can be made applicable, the |
|
|
provisions of Subsections (b)(1), (2), (3), (4), and (5) also apply |
|
|
to civilian employees of the Department of Public Safety who are |
|
|
assigned to the driver's license facilities of the department. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
