A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to procurement methods of the Ector County Hospital |
|
|
District for the construction, rehabilitation, alteration, or |
|
|
repair of certain projects. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1024.105, Special District Local Laws |
|
|
Code, as effective April 1, 2009, is amended to read as follows: |
|
|
Sec. 1024.105. PURCHASING AND ACCOUNTING PROCEDURES. (a) |
|
|
The board may prescribe: |
|
|
(1) the method of making purchases and expenditures by |
|
|
and for the district; and |
|
|
(2) accounting and control procedures for the |
|
|
district. |
|
|
(b) The board may act as a governmental entity under |
|
|
Subchapter H, Chapter 271, Local Government Code, for purposes of |
|
|
using the procurement procedures authorized by that chapter. For |
|
|
purposes of this subsection, notice under Section 271.112(d), Local |
|
|
Government Code, must be provided by the district in the same manner |
|
|
as provided for a conservation and reclamation district created |
|
|
under Section 59, Article XVI, Texas Constitution. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
