A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to additional sick leave for certain peace officers and |
|
corrections officers who work overtime. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter G, Chapter 661, Government Code, is |
|
amended by adding Section 661.2021 to read as follows: |
|
Sec. 661.2021. ADDITIONAL SICK LEAVE FOR PEACE OFFICERS AND |
|
CORRECTIONS OFFICERS. (a) This section applies only to: |
|
(1) a state employee who is a peace officer under |
|
Article 2.12, Code of Criminal Procedure, and commissioned by a |
|
state officer or state agency; and |
|
(2) a member of the class of employees of the |
|
institutional division or the state jail division of the Texas |
|
Department of Criminal Justice formally designated as custodial |
|
personnel under Section 615.006 by the Texas Board of Criminal |
|
Justice or its predecessor in function. |
|
(b) In addition to the sick leave provided under Section |
|
661.202(c), a person described by Subsection (a) who works overtime |
|
during a month accrues additional sick leave for the month as |
|
follows: |
|
(1) less than 20 hours of overtime during the month, |
|
one hour of sick leave; |
|
(2) at least 20 hours but less than 40 hours of |
|
overtime during the month, two hours of sick leave; |
|
(3) at least 40 hours but less than 60 hours of |
|
overtime during the month, three hours of sick leave; |
|
(4) at least 60 hours but less than 80 hours of |
|
overtime during the month, four hours of sick leave; and |
|
(5) 80 hours or more of overtime during the month, five |
|
hours of sick leave. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
