A BILL TO BE ENTITLED
 
AN ACT
  relating to the contents of a receipt issued for payment of a good
  or service; providing a civil penalty.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 501, Business & Commerce
  Code, as effective April 1, 2009, is amended by adding Section
  501.1011 to read as follows:
         Sec. 501.1011.  SALES RECEIPT CONTAINING DRIVER'S LICENSE
  NUMBER PROHIBITED. A person may not print an individual's driver's
  license number on a receipt that evidences payment for a sale of
  goods or services and is provided to the individual.
         SECTION 2.  Section 501.102, Business & Commerce Code, as
  effective April 1, 2009, is amended by amending Subsection (a) and
  adding Subsection (a-1) to read as follows:
         (a)  A person who violates Section 501.101 [this subchapter]
  is liable to this state for a civil penalty in an amount not to
  exceed $500 for each violation.  The attorney general or the
  prosecuting attorney in the county in which the violation occurs
  may bring an action to recover the civil penalty imposed under this
  subsection [section].
         (a-1)  A person who violates Section 501.1011 is liable to
  this state for a civil penalty in an amount not to exceed $500 for
  each calendar month in which a violation occurs. The civil penalty
  may not be imposed for more than one violation that occurs in a
  month. The attorney general or the prosecuting attorney in the
  county in which the violation occurs may bring an action to recover
  the civil penalty imposed under this subsection.
         SECTION 3.  This Act takes effect January 1, 2010.
