A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an abortion for a victim of incest or sexual assault. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 171.011, Health and Safety Code, is |
|
|
amended to read as follows: |
|
|
Sec. 171.011. INFORMED CONSENT REQUIRED. (a) A person may |
|
|
not perform an abortion without the voluntary and informed consent |
|
|
of the woman on whom the abortion is to be performed. |
|
|
(b) If a pregnancy is the result of conduct constituting a |
|
|
felony, including incestuous sexual conduct prohibited by Section |
|
|
25.02, Penal Code, or sexual assault prohibited by Section 22.011 |
|
|
or 22.021, Penal Code, a person may obtain the voluntary and |
|
|
informed consent of the woman without complying with this |
|
|
subchapter. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
