A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to an exemption from the structural pest control license |
|
requirement for certain falconers. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 1951, Occupations Code, is |
|
amended by adding Section 1951.057 to read as follows: |
|
Sec. 1951.057. FALCONERS. (a) This chapter does not apply |
|
to a person engaged in falconry, as defined by Section 49.001, Parks |
|
and Wildlife Code, who: |
|
(1) is the holder of a falconer's permit as provided by |
|
Chapter 49, Parks and Wildlife Code; and |
|
(2) uses a raptor to control or relocate other birds. |
|
(b) A person described by Subsection (a) is not considered |
|
to be engaged in the business of structural pest control. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
