A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the eligibility of school districts in certain counties |
|
|
to enter into agreements under the Texas Economic Development Act. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 313.051(a), Tax Code, is amended to read |
|
|
as follows: |
|
|
(a) This subchapter applies only to a school district that |
|
|
has territory in: |
|
|
(1) an area that qualified as a strategic investment |
|
|
area under Subchapter O, Chapter 171, immediately before that |
|
|
subchapter expired [, as defined by Section 171.721]; or |
|
|
(2) a county: |
|
|
(A) that has a population of less than 50,000; |
|
|
and |
|
|
(B) [that is not partially or wholly located in a
|
|
|
metropolitan statistical area; and
|
|
|
[(C)] in which, from 1990 to 2000, according to |
|
|
the federal decennial census, the population: |
|
|
(i) remained the same; |
|
|
(ii) decreased; or |
|
|
(iii) increased, but at a rate of not more |
|
|
than three percent per annum. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
