A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the counting of a provisional ballot cast by a voter in |
|
|
a precinct in which the voter does not reside. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 65.054, Election Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) For a provisional ballot cast outside the precinct in |
|
|
which a voter resides, the board shall accept the ballot of a voter |
|
|
who is registered to vote in this state but only count a vote cast |
|
|
for: |
|
|
(1) an office or proposition stating a measure for |
|
|
which a statewide election was held; and |
|
|
(2) an office or proposition stating a measure in a |
|
|
territorial unit of which the voter was entitled to vote at the |
|
|
voter's registered address. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
