A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the right of persons to pursue remedies under certain |
|
|
laws instead of appealing to the commissioner of education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 7.057, Education Code, is amended by |
|
|
adding Subsection (a-1) to read as follows: |
|
|
(a-1) A person is not required to appeal to the commissioner |
|
|
before pursuing a remedy under a law outside of Title 1 or this |
|
|
title to which Title 1 or this title makes reference or with which |
|
|
Title 1 or this title requires compliance. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
