A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the expansion of services provided under the child |
|
health plan program for certain adolescents. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 62.151, Health and Safety Code, is |
|
amended by amending Subsection (c) and adding Subsection (c-1) to |
|
read as follows: |
|
(c) In developing the plan, the commission, except as |
|
provided by Subsection (c-1), shall ensure that primary and |
|
preventive health benefits do not include reproductive services, |
|
other than prenatal care and care related to diseases, illnesses, |
|
or abnormalities related to the reproductive system. |
|
(c-1) The commission shall ensure that an enrolled |
|
adolescent who is at least 16 years of age has access to |
|
comprehensive family planning services, except services related to |
|
abortion or emergency contraception, as a covered benefit if the |
|
adolescent already has at least one child. |
|
SECTION 2. If before implementing any provision of this Act |
|
a state agency determines that a waiver or authorization from a |
|
federal agency is necessary for implementation of that provision, |
|
the agency affected by the provision shall request the waiver or |
|
authorization and may delay implementing that provision until the |
|
waiver or authorization is granted. |
|
SECTION 3. This Act takes effect September 1, 2009. |
