A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice requirements in certain counties for hearings in |
|
|
suits for dissolution of marriage and suits affecting the |
|
|
parent-child relationship. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 6, Family Code, is amended |
|
|
by adding Section 6.412 to read as follows: |
|
|
Sec. 6.412. NOTICE OF HEARING DATE. (a) This section |
|
|
applies only to a court in a county with a population of one million |
|
|
or more. |
|
|
(b) The court shall give notice of the date of a hearing in a |
|
|
suit for dissolution of a marriage in accordance with Section |
|
|
105.0031. |
|
|
SECTION 2. Chapter 105, Family Code, is amended by adding |
|
|
Section 105.0031 to read as follows: |
|
|
Sec. 105.0031. NOTICE OF HEARING DATE. (a) This section |
|
|
applies only to a court in a county with a population of one million |
|
|
or more. |
|
|
(b) After a hearing date on a petition or motion in a |
|
|
proceeding filed under this title is set, the court shall promptly |
|
|
give written notice of the hearing date to the petitioner or movant. |
|
|
(c) Notwithstanding Section 22.004, Government Code, the |
|
|
supreme court may not amend or adopt rules in conflict with this |
|
|
section. |
|
|
SECTION 3. The change in law made by this Act applies only |
|
|
to a petition or motion filed on or after the effective date of this |
|
|
Act. A petition or motion filed before that date is governed by the |
|
|
law in effect immediately before that date, and the former law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 4. This Act takes effect September 1, 2009. |
