A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the possession of a child less than three years of age |
|
|
in a suit affecting the parent-child relationship. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 153.254(a), Family Code, is amended to |
|
|
read as follows: |
|
|
(a) The court may [shall] render an order appropriate under |
|
|
the circumstances for possession of a child less than three years of |
|
|
age if the court finds that possession of the child by the |
|
|
conservator with whom the child does not primarily reside is in the |
|
|
best interest of the child. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
suit affecting the parent-child relationship that is pending in a |
|
|
trial court on the effective date of this Act or that is filed on or |
|
|
after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
