A BILL TO BE ENTITLED
 
AN ACT
  relating to the purchase of library goods and services by public
  junior colleges.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 44.0311, Education Code, is amended by
  amending Subsection (a) and adding Subsection (c) to read as
  follows:
         (a)  Except as provided by Subsection (c), this [This]
  subchapter applies to junior college districts.
         (c)  This subchapter does not apply to a purchase,
  acquisition, or license of library goods and services for a library
  operated as a part of a junior college district. In this
  subsection, "library goods and services" has the meaning assigned
  by Section 130.0101(a).
         SECTION 2.  Section 130.0101, Education Code, is amended to
  read as follows:
         Sec. 130.0101.  ACQUISITION OF LIBRARY MATERIALS.  (a)  In
  this section, "library goods and services" means:
               (1)  serial and journal subscriptions, including
  electronic databases, digital content, and information products;
               (2)  other library materials and resources, including
  books, e-books, and media not available under a statewide contract
  and papers;
               (3)  library services, including periodical jobber and
  binding services not available under a statewide contract; [and]
               (4)  library equipment and supplies; and
               (5)  library or resource-sharing programs operated by
  the Texas State Library and Archives Commission.
         (b)  Notwithstanding any other law governing purchasing by a
  junior college district, including Section 130.010 or Subchapter B,
  Chapter 44, a junior college district may purchase, license, or
  otherwise acquire library goods and services in any manner
  authorized by law for the purchase, license, or acquisition of
  library goods and services by a public senior college or
  university, as defined by Section 61.003.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
