A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a peace officer to stop, detain, or |
|
|
arrest a person for a violation of certain traffic offenses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 543.001, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 543.001. ARREST WITHOUT WARRANT AUTHORIZED. (a) |
|
|
Except as provided by Subsection (b), any [Any] peace officer may |
|
|
arrest without warrant a person found committing a violation of |
|
|
this subtitle. |
|
|
(b) A peace officer operating a vehicle may not stop, |
|
|
detain, or arrest the operator or occupant of a vehicle for a |
|
|
violation of this subtitle that is a misdemeanor punishable by a |
|
|
fine only unless: |
|
|
(1) the officer's vehicle is clearly marked as a police |
|
|
vehicle, as defined by Section 541.201; and |
|
|
(2) the officer is wearing a uniform on which is |
|
|
displayed the officer's badge of office. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
