A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to authorizing certain municipalities and counties to |
|
enter into interlocal contracts for the provision of law |
|
enforcement services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 791, Government Code, is |
|
amended by adding Section 791.034 to read as follows: |
|
Sec. 791.034. CONTRACTS FOR THE PROVISION OF LAW |
|
ENFORCEMENT SERVICES IN CERTAIN MUNICIPALITIES. (a) This section |
|
applies only to: |
|
(1) a county with a population of more than 650,000 |
|
located within 100 miles of an international border; and |
|
(2) a municipality located entirely in a county |
|
described by Subdivision (1). |
|
(b) A municipality that enters into an interlocal contract |
|
with a county under this chapter for the county to provide law |
|
enforcement services to the municipality may abolish its municipal |
|
police department. |
|
(c) A county that enters into an interlocal contract with a |
|
municipality under this chapter for the county to provide law |
|
enforcement services to the municipality must assign county law |
|
enforcement officers to discharge official duties in the |
|
municipality. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
