A BILL TO BE ENTITLED
 
AN ACT
  relating to authorizing certain municipalities and counties to
  enter into interlocal contracts for the provision of law
  enforcement services.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 791, Government Code, is
  amended by adding Section 791.034 to read as follows:
         Sec. 791.034.  CONTRACTS FOR THE PROVISION OF LAW
  ENFORCEMENT SERVICES IN CERTAIN MUNICIPALITIES. (a) This section
  applies only to:
               (1)  a county with a population of more than 650,000
  located within 100 miles of an international border; and
               (2)  a municipality located entirely in a county
  described by Subdivision (1).
         (b)  A municipality that enters into an interlocal contract
  with a county under this chapter for the county to provide law
  enforcement services to the municipality may abolish its municipal
  police department.
         (c)  A county that enters into an interlocal contract with a
  municipality under this chapter for the county to provide law
  enforcement services to the municipality must assign county law
  enforcement officers to discharge official duties in the
  municipality.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
