A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to suits for adoption of a child in certain cases involving |
|
|
the Department of Family and Protective Services. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 162.002, Family Code, is |
|
|
amended to read as follows: |
|
|
Sec. 162.002. [PREREQUISITES TO] PETITION FOR ADOPTION. |
|
|
SECTION 2. Section 162.002, Family Code, is amended by |
|
|
adding Subsection (c) to read as follows: |
|
|
(c) If the parent-child relationship between a child and |
|
|
each living parent was previously terminated in a proceeding |
|
|
initiated by the Department of Family and Protective Services, a |
|
|
petition for adoption of the child shall be filed: |
|
|
(1) in the court that previously terminated the |
|
|
parent-child relationship between the child and each living parent; |
|
|
and |
|
|
(2) under the same cause number as the proceeding in |
|
|
which the parent-child relationships were terminated. |
|
|
SECTION 3. The changes in law made by this Act to Section |
|
|
162.002, Family Code, apply to a petition for adoption that is filed |
|
|
on or after the effective date of this Act. A petition for adoption |
|
|
filed before the effective date of this Act is governed by the law |
|
|
in effect on the date the petition was filed, and the former law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 4. This Act takes effect September 1, 2009. |
