A BILL TO BE ENTITLED
 
AN ACT
  relating to a study regarding uniform election dates.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  (a)  The secretary of state shall conduct a study
  to evaluate the feasibility and advisability of eliminating by 2013
  the uniform election date in May.
         (b)  In conducting the study, the secretary of state shall
  consider:
               (1)  whether voting districts would need to be
  consolidated if the uniform election date in May were eliminated;
               (2)  whether longer ballots would negatively affect
  voter behavior; and
               (3)  any likely effects on local governments of
  eliminating the uniform election date in May.
         (c) The secretary of state shall develop recommendations on
  how to mitigate or avoid any negative effects that may result from
  eliminating the uniform election date in May.
         (d) Following the study, the secretary of state shall file a
  written report containing findings with the speaker of the house of
  representatives and the lieutenant governor not later than December
  1, 2010.
         SECTION 2.  This Act takes effect September 1, 2009.
