A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of certain counties to use unclaimed |
|
money for the benefit of the county. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 74, Property Code, is |
|
amended by adding Section 74.3014 to read as follows: |
|
Sec. 74.3014. DELIVERY OF MONEY IN CERTAIN COUNTIES. (a) |
|
Notwithstanding and in addition to any other provision of this |
|
chapter or other law, a county having a population of less than |
|
25,000 in which the state or one of its political subdivisions, |
|
including an institution of higher education, owns more than 25 |
|
percent of the land in the county may deliver reported money to a |
|
fund established by the county to benefit the county instead of |
|
delivering the money to the comptroller as required by Section |
|
74.301. |
|
(b) Money in the county fund may be distributed in the form |
|
of grants to nonprofit, nonreligious organizations that work for |
|
the betterment of the county through education, recreation, |
|
culture, or protecting the health and safety of the county. |
|
(c) A county shall file with the comptroller a verification |
|
of money delivered under this section that complies with Section |
|
74.302. |
|
(d) A claim for money delivered under this section must be |
|
filed with the county that delivered the money. The county shall |
|
pay the claim if the county determines in good faith that the claim |
|
is valid. A person aggrieved by a claim decision may file suit |
|
against the county in a district court in the county in accordance |
|
with Section 74.506. |
|
(e) The comptroller shall prescribe the forms and |
|
procedures governing this section, including forms and procedures |
|
relating to: |
|
(1) notice of presumed abandoned property; |
|
(2) delivery of reported money to the county fund; and |
|
(3) filing of a claim. |
|
SECTION 2. This Act takes effect September 1, 2009. |
