A BILL TO BE ENTITLED
 
AN ACT
  relating to prohibiting accepting federal funding for
  abstinence-only education.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 531, Health and Safety
  Code, is amended by adding Section 531.0281 to read as follows:
         Sec. 531.0281.  FEDERAL FUNDING FOR ABSTINENCE-ONLY
  EDUCATION. (a) In this section, "abstinence-only education" means
  an educational or motivational program that does not include
  information about preventing pregnancy, sexually transmitted
  diseases, infection with human immunodeficiency virus, or acquired
  immune deficiency syndrome through any means other than total
  abstinence from sexual activity.
         (b)  The commission may not apply for or accept federal
  funds, including funds under Section 510, Social Security Act (42
  U.S.C. Section 710), for abstinence-only education.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
