A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to prohibiting accepting federal funding for |
|
|
abstinence-only education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 531, Health and Safety |
|
|
Code, is amended by adding Section 531.0281 to read as follows: |
|
|
Sec. 531.0281. FEDERAL FUNDING FOR ABSTINENCE-ONLY |
|
|
EDUCATION. (a) In this section, "abstinence-only education" means |
|
|
an educational or motivational program that does not include |
|
|
information about preventing pregnancy, sexually transmitted |
|
|
diseases, infection with human immunodeficiency virus, or acquired |
|
|
immune deficiency syndrome through any means other than total |
|
|
abstinence from sexual activity. |
|
|
(b) The commission may not apply for or accept federal |
|
|
funds, including funds under Section 510, Social Security Act (42 |
|
|
U.S.C. Section 710), for abstinence-only education. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
