A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the regulation by the Railroad Commission of Texas of |
|
|
the transportation of drilling mud; providing an administrative |
|
|
penalty. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 91, Natural Resources |
|
|
Code, is amended by adding Section 91.118 to read as follows: |
|
|
Sec. 91.118. REQUIREMENTS FOR TRANSPORTING DRILLING MUD. |
|
|
(a) The commission by rule shall require a person who operates a |
|
|
motor vehicle that is used to transport drilling mud to equip and |
|
|
maintain the vehicle in a manner that prevents the drilling mud from |
|
|
escaping from, or being deposited on a public road or highway by, |
|
|
the vehicle. |
|
|
(b) The commission may assess an administrative penalty as |
|
|
provided by Sections 81.0531-81.0534 against a person who violates |
|
|
this section or a rule adopted under this section. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
