A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the inclusion of public school employees in the group of |
|
|
persons protected from harassment in the public schools. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 37.001(b)(1), Education Code, is amended |
|
|
to read as follows: |
|
|
(1) "Harassment" means threatening to cause harm or |
|
|
bodily injury to another student or a school employee, engaging in |
|
|
sexually intimidating conduct, causing physical damage to the |
|
|
property of another student or a school employee, subjecting |
|
|
another student or a school employee to physical confinement or |
|
|
restraint, or maliciously taking any action that substantially |
|
|
harms the [another student's] physical or emotional health or |
|
|
safety of another student or a school employee. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
