A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the service retirement annuity for certain members of |
|
the Judicial Retirement System of Texas Plan Two. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 839.102(a), Government Code, as amended |
|
by Chapters 1033 (H.B. 1114) and 1203 (H.B. 617), Acts of the 79th |
|
Legislature, Regular Session, 2005, is reenacted and amended to |
|
read as follows: |
|
(a) Except as provided by Subsections (b), (b-1), (c), (d), |
|
and (f), the standard service retirement annuity is an amount equal |
|
to 50 percent of the state salary being paid at the time the member |
|
retires to a judge of a court of the same classification as the last |
|
court to which the retiring member was elected or appointed. |
|
SECTION 2. Section 839.102, Government Code, is amended by |
|
adding Subsection (b-1) to read as follows: |
|
(b-1) The retirement system shall increase by 10 percent of |
|
the amount of the applicable state salary under Subsection (a), |
|
(b), or (c) the annuity of a member who on the effective date of |
|
retirement has continuously made contributions to the retirement |
|
system and has: |
|
(1) acquired at least 22 years of service credit as a |
|
district judge; or |
|
(2) acquired at least 20 years of service credit as an |
|
appellate judge. |
|
SECTION 3. The change in law made by this Act applies only |
|
to a person who retires on or after the effective date of this Act. |
|
The change in law does not apply to a person who retired before the |
|
effective date of this Act. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
