A BILL TO BE ENTITLED
 
AN ACT
  relating to the extent and management of the John Graves Scenic
  Riverway.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 26.551(2), Water Code, is amended to
  read as follows:
               (2)  "John Graves Scenic Riverway" means that portion
  of the Brazos River Basin, and its contributing watershed, located
  downstream of the Morris Shepard Dam on the Possum Kingdom
  Reservoir in Palo Pinto County, Texas, and extending to the county
  line between Somervell and Bosque [Parker and Hood] Counties,
  Texas, including that portion of the river basin and contributing
  watershed in Johnson County.
         SECTION 2.  Section 26.555(b), Water Code, is amended to
  read as follows:
         (b)  The visual inspections and the drawing of water samples
  must be conducted at least once in a winter month and at least once
  in a summer month.  The visual inspections must be conducted [both]
  from the surface of the John Graves Scenic Riverway or [and] from an
  aircraft flying over the riverway.
         SECTION 3.  The Texas Commission on Environmental Quality as
  soon as practicable shall amend its rules as necessary to include in
  the John Graves Scenic Riverway pilot program under Subchapter M,
  Chapter 26, Water Code, the area added to the John Graves Scenic
  Riverway by this Act. The commission shall begin enforcement of
  Subchapter M, Chapter 26, Water Code, in the area added to the John
  Graves Scenic Riverway on January 1, 2010.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
