A BILL TO BE ENTITLED

|
AN ACT
|
|
relating to accountability for gifted and talented programs |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 39, Education Code, is amended by adding |
|
Section 39.117, to read as follows: |
|
Section 39.117. GIFTED AND TALENTED STANDARDS. The |
|
commissioner shall adopt standards for the evaluation of gifted and |
|
talented programs. A school that uses the Texas Performance |
|
Standards Project or another program approved by the commissioner |
|
that meets the requirements of the Texas state plan for the |
|
education of gifted and talented students under section 29.123 and |
|
receives a satisfactory rating under the standards set by the |
|
commissioner shall not be subject to the limitation under 42.156 |
|
(c) for the following two school years. If a district fails to |
|
receive a satisfactory rating for two consecutive school years, it |
|
shall be subject to the limitation under 42.156 (c) until the year |
|
following a satisfactory rating. |

Section 2. Section 42.156 (c) is amended to read as follows: |
|
(c) Except as provided in Section 39.117, not more than five |
|
percent of a district's students in average daily attendance are |
|
eligible for funding under this section. |
|
Section 3. The commissioner shall adopt standards for the |
|
evaluation of gifted and talented programs for the evaluation of |
|
gifted and talented programs no later than September 1, 2010. |
|
Section 4. This Act takes effect September 1, 2009. |
