A BILL TO BE ENTITLED
 
AN ACT
  relating to a biennial report on the cost to the state of services
  provided to illegal aliens.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 322, Government Code, is amended by
  adding Section 322.021 to read as follows:
         Sec. 322.021.  REPORT ON COST OF SERVICES FOR ILLEGAL
  ALIENS. (a) In this section, "illegal alien" means a person who:
               (1)  is not a citizen or national of the United States;
  and
               (2)  is unlawfully present in the United States
  according to the terms of 8 U.S.C. Section 1101 et seq.
         (b)  The board shall prepare a report on the cost of services
  provided by the state and political subdivisions to illegal aliens
  using state funds during each state fiscal biennium. In preparing
  the report, the board shall consider available reports and other
  information from state agencies and political subdivisions.
         (c)  Not later than January 1 of each odd-numbered year, the
  board shall distribute the report covering the previous state
  fiscal biennium to the governor, lieutenant governor, members of
  the legislature, comptroller, members of the United States Congress
  representing this state, and President of the United States. The
  report must include a cover letter that explicitly summarizes the
  total known cost to the state of services provided to illegal
  aliens. The report may be distributed electronically.
         (d)  The board and the comptroller shall each clearly display
  the contents of the report on their public Internet websites.
         SECTION 2.  This Act takes effect September 1, 2009.
