A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to coverage for prostate cancer screenings for men 40 |
|
|
years of age or older. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1362.003(b), Insurance Code, is amended |
|
|
to read as follows: |
|
|
(b) Coverage required under this section includes at a |
|
|
minimum: |
|
|
(1) a physical examination for the detection of |
|
|
prostate cancer; and |
|
|
(2) a prostate-specific antigen test used for the |
|
|
detection of prostate cancer for each male who is 40 years of age or |
|
|
older[:
|
|
|
[(A)
is at least 50 years of age and is
|
|
|
asymptomatic; or
|
|
|
[(B)
is at least 40 years of age and has a family
|
|
|
history of prostate cancer or another prostate cancer risk factor]. |
|
|
SECTION 2. This Act applies only to an insurance policy or |
|
|
contract or evidence of coverage that is delivered, issued for |
|
|
delivery, or renewed on or after January 1, 2010. An insurance |
|
|
policy or contract or evidence of coverage delivered, issued for |
|
|
delivery, or renewed before January 1, 2010, is governed by the law |
|
|
as it existed immediately before the effective date of this Act, and |
|
|
that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
