A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to exempting prepaid wireless telecommunications devices |
|
|
from the 9-1-1 emergency service fee. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 771.001, Health and Safety Code, is |
|
|
amended by adding Subdivision (6-a) to read as follows: |
|
|
(6-a) "Prepaid wireless telecommunications device" |
|
|
means a mobile telephone, service, or SIM card for which access to |
|
|
wireless communication service is provided to a customer without |
|
|
the customer being required to enter into a credit account. |
|
|
SECTION 2. Section 771.0711, Health and Safety Code, is |
|
|
amended by adding Subsection (a-1) to read as follows: |
|
|
(a-1) Neither the commission nor a political subdivision |
|
|
may impose a fee on a prepaid wireless telecommunications device |
|
|
for 9-1-1 emergency service. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
