A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to extension of water and sewer utility services to |
|
certain public school facilities or hospital facilities to |
|
supplement services provided by the holder of a certificate of |
|
public convenience and necessity. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter G, Chapter 13, Water Code, is amended |
|
by adding Section 13.258 to read as follows: |
|
Sec. 13.258. SUPPLEMENTAL SERVICES FOR CERTAIN PUBLIC |
|
SCHOOL OR HOSPITAL FACILITIES. (a) A retail public utility, on the |
|
request of a school district, a hospital, or a hospital district |
|
that has a facility located in the certificated area of another |
|
retail public utility and that is located within 100 kilometers of |
|
this state's international border, may extend water or sewer |
|
services to a facility of the school district, hospital, or |
|
hospital district to provide supplemental services that the |
|
facility may use at any time the services of the certificated retail |
|
public utility are interrupted or inadequate. A certificate of |
|
public convenience and necessity or an amendment to a certificate |
|
is not required for the extension. |
|
(b) The retail public utility extending services under |
|
Subsection (a) shall ensure that the water lines and other |
|
facilities the retail public utility connects to the school or |
|
hospital facility do not interfere with the ability of the |
|
certificated retail public utility to provide services to the |
|
school or hospital facility. |
|
(c) The retail public utility extending services under |
|
Subsection (a) shall provide written notice to the commission at |
|
the time services are extended. |
|
SECTION 2. This Act takes effect September 1, 2009. |
