A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to notice of proposed increases in fees charged by the |
|
|
Parks and Wildlife Department for certain permits. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 43, Parks and Wildlife Code, is amended |
|
|
by adding Subchapter A to read as follows: |
|

SUBCHAPTER A. GENERAL PROVISIONS |
|
|
[Sec. 43.001. Reserved] |
|
|
Sec. 43.002. NOTICE OF PROPOSED PERMIT FEE INCREASE. The |
|
|
department shall provide written notice to a person who holds an |
|
|
unexpired permit or held a permit in the preceding year issued by |
|
|
the department under Subchapter E, L, or R at least 90 days before |
|
|
the date on which the amount of the fee for that type of permit is |
|
|
proposed to increase. Notice under this section is required only if |
|
|
the proposed permit fee amount is at least two times the amount of |
|
|
the fee in effect for a permit of that type. |
|
|
SECTION 2. Section 43.002, Parks and Wildlife Code, as |
|
|
added by this Act, applies only to an increase in the fee for a |
|
|
permit as provided by that section that is proposed to take effect |
|
|
on or after September 1, 2009. An increase in the fee for a permit |
|
|
that is proposed to take effect before September 1, 2009, is |
|
|
governed by the law in effect immediately before September 1, 2009, |
|
|
and that law continues in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
