A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice of proposed increases in fees charged by the |
|
|
Parks and Wildlife Department for certain permits. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 43, Parks and Wildlife Code, is amended |
|
|
by adding Subchapter A to read as follows: |
|
|

|
|
Sec. 43.002. NOTICE OF PROPOSED PERMIT FEE INCREASE. (a) |
|
|
Except as provided by Subsections (b) and (c), the department shall |
|
|
provide written notice to a person who holds a permit issued by the |
|
|
department under this chapter at least 90 days before the date on |
|
|
which the amount of the fee for that type of permit is proposed to |
|
|
increase. |
|
|
(b) The department is required to provide notice under |
|
|
Subsection (a) only if the proposed permit fee amount is at least |
|
|
three times the amount of the fee in effect for a permit of that |
|
|
type. |
|
|
(c) The notice requirement under this section does not apply |
|
|
to a proposed fee increase for a license or other authorization |
|
|
issued by the department under this chapter. |
|
|
SECTION 2. Section 43.002, Parks and Wildlife Code, as |
|
|
added by this Act, applies only to an increase in the fee for a |
|
|
permit as provided by that section that is proposed to take effect |
|
|
on or after September 1, 2009. An increase in the fee for a permit |
|
|
that is proposed to take effect before September 1, 2009, is |
|
|
governed by the law in effect immediately before September 1, 2009, |
|
|
and that law continues in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
