A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a municipal consent agreement regarding the inclusion |
|
of land in the extraterritorial jurisdiction of a municipality on |
|
the creation or expansion of certain municipal utility districts. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. (a) Section 54.016(f), Water Code, is repealed. |
|
(b) Section 54.016(h), Water Code, is repealed. |
|
SECTION 2. The legislature finds that an agreement between |
|
a municipality and a municipal utility district is an allocation |
|
agreement only if the agreement strictly complies with the |
|
requirements of Section 54.016(f), Water Code, and is specifically |
|
designated by the parties to the agreement as an "allocation |
|
agreement." |
|
SECTION 3. The changes in law made by this Act do not apply |
|
to an agreement that is the subject of a lawsuit filed by a |
|
political subdivision before the effective date of this Act. A |
|
lawsuit filed before the effective date of this Act is governed by |
|
the law in effect on the date the lawsuit was filed, and the former |
|
law is continued in effect for that purpose. |

SECTION 4. (a) Section 1(a) of this Act takes effect January |
|
1, 2010. |
|
(b) Except as provided by Subsection (a) of this section, |
|
this Act takes effect immediately if it receives a vote of |
|
two-thirds of all the members elected to each house, as provided by |
|
Section 39, Article III, Texas Constitution. If this Act does not |
|
receive the vote necessary for immediate effect, this Act takes |
|
effect September 1, 2009. |
