A BILL TO BE ENTITLED
 
AN ACT
  relating to notification of policyholders of changes in residential
  property insurance policies.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 2002, Insurance Code, is amended by
  adding Subchapter D to read as follows:
  SUBCHAPTER D. NOTIFICATION REGARDING POLICY CHANGES
         Sec. 2002.151.  DEFINITION. In this subchapter,
  "residential property insurance" means insurance coverage against
  loss to tangible personal property or to residential real property
  at a fixed location that is provided through a homeowners insurance
  policy, including a tenants insurance policy, a condominium owners
  insurance policy, or a residential fire and allied lines insurance
  policy.
         Sec. 2002.152.  NOTICE REGARDING CHANGES. An insurer that
  delivers, issues for delivery, or renews a policy of residential
  property insurance in this state shall notify the policyholder of
  any changes in the policy through a written statement:
               (1)  delivered by certified mail; or
               (2)  provided to the policyholder by the insurance
  agent representing the insurer who is the servicing agent on the
  policy.
         Sec. 2002.153.  RULES. The commissioner may adopt rules as
  necessary to implement this subchapter.
         SECTION 2.  This Act applies only to a residential property
  insurance policy delivered, issued for delivery, or renewed on or
  after January 1, 2010. A policy delivered, issued for delivery, or
  renewed before January 1, 2010, is governed by the law as it existed
  immediately before the effective date of this Act, and that law is
  continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2009.
