A BILL TO BE ENTITLED
 
AN ACT
  relating to retirement benefits for certain police officers in
  certain municipalities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 451 (S.B. 737), Acts of the 72nd
  Legislature, Regular Session, 1991 (Article 6243n, Vernon's Texas
  Civil Statutes), is amended by adding Section 14 to read as follows:
         Sec. 14.  CERTAIN TRANSFERRED PEACE OFFICERS. (a)
  Notwithstanding any other law, a member of the retirement system
  who served as a peace officer in a municipal department other than
  the police department and whom the governing body of the
  municipality has transferred to the police department on or after
  the member's normal retirement date may, as an alternative to
  participating in the proportionate retirement program under
  Chapter 803, Government Code, elect to receive a retirement
  allowance under this Act while remaining actively employed by the
  police department.
         (b)  If a member elects to receive the retirement allowance
  authorized by this section, the allowance must be calculated and
  paid retroactively from the date of the member's transfer to the
  police department.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
