A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to retirement benefits for certain police officers in |
|
certain municipalities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 451 (S.B. 737), Acts of the 72nd |
|
Legislature, Regular Session, 1991 (Article 6243n, Vernon's Texas |
|
Civil Statutes), is amended by adding Section 14 to read as follows: |
|
Sec. 14. CERTAIN TRANSFERRED PEACE OFFICERS. (a) |
|
Notwithstanding any other law, a member of the retirement system |
|
who served as a peace officer in a municipal department other than |
|
the police department and whom the governing body of the |
|
municipality has transferred to the police department on or after |
|
the member's normal retirement date may, as an alternative to |
|
participating in the proportionate retirement program under |
|
Chapter 803, Government Code, elect to receive a retirement |
|
allowance under this Act while remaining actively employed by the |
|
police department. |
|
(b) If a member elects to receive the retirement allowance |
|
authorized by this section, the allowance must be calculated and |
|
paid retroactively from the date of the member's transfer to the |
|
police department. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
