A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the execution docket of certain court clerks. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 30, Civil Practice and Remedies Code, is |
|
|
amended by adding Section 30.018 to read as follows: |
|
|
Sec. 30.018. COURT CLERK'S EXECUTION DOCKET. (a) The clerk |
|
|
of a court who is required to enter information into an execution |
|
|
docket under the Texas Rules of Civil Procedure or other law may |
|
|
enter and maintain the information in an electronic format that |
|
|
allows the information to be retrieved on the same basis as |
|
|
information would be retrieved manually using an index or |
|
|
cross-index to the docket that is otherwise required by law. |
|
|
(b) Notwithstanding Section 22.004, Government Code, the |
|
|
supreme court may not amend or adopt rules in conflict with this |
|
|
section. |

|
SECTION 2. This Act takes effect September 1, 2009. |
