A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the location of water utility rate hearings conducted |
|
|
by the Texas Commission on Environmental Quality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 13.041(c), Water Code, is amended to |
|
|
read as follows: |
|
|
(c) The commission may call and hold hearings, administer |
|
|
oaths, receive evidence at hearings, issue subpoenas to compel the |
|
|
attendance of witnesses and the production of papers and documents, |
|
|
and make findings of fact and decisions with respect to |
|
|
administering this chapter or the rules, orders, or other actions |
|
|
of the commission. A hearing under this subsection shall be held at |
|
|
a location within the service area of the utility that is the |
|
|
subject of the hearing. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
