A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the holidays for members of fire and police departments |
|
|
in certain municipalities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 142.0013, Local Government Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) A fire fighter or police officer is entitled to a paid |
|
|
day off from working on September 11 of each year if: |
|
|
(1) the fire fighter or police officer: |
|
|
(A) agrees or is required to work on a holiday |
|
|
during the same fiscal year and chooses to take that holiday on |
|
|
September 11; or |
|
|
(B) chooses to use a vacation day, a day in lieu |
|
|
of a vacation day or holiday, or accumulated compensatory leave to |
|
|
take a paid day off on September 11; and |
|
|
(2) the fire fighter's or police officer's supervisor |
|
|
does not require the fire fighter or police officer to work that day |
|
|
to maintain minimum staffing necessary for public safety. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
