A BILL TO BE ENTITLED
 
AN ACT
  relating to the physician education loan repayment program.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sections 153.053(a) and (c), Occupations Code,
  are amended to read as follows:
         (a)  The board shall collect a fee surcharge as follows:
               (1)  $200 for the license fee;
               (2)  $425 [$400] for the first registration permit;
               (3)  $425 [$400] for renewal of a registration permit;
  and
               (4)  $200 for reinstatement of a license after
  cancellation for cause.
         (c)  Of each surcharge collected under Subsections (a)(2)
  and (3), the board shall deposit $110 [$100] to the credit of the
  foundation school fund, $25 to the credit of the account created
  under Section 61.5391, Education Code, and the remainder [$300] to
  the credit of the general revenue fund.
         SECTION 2.  Section 61.535(a), Education Code, is amended to
  read as follows:
         (a)  The coordinating board shall deliver any repayment made
  under this subchapter in a lump sum:
               (1)  payable to both the lender and the physician, in
  accordance with federal law; or
               (2)  delivered directly to the lender on behalf of the
  physician in electronic form.
         SECTION 3.  Subchapter J, Chapter 61, Education Code, is
  amended by adding Section 61.5391 to read as follows:
         Sec. 61.5391.  PHYSICIAN EDUCATION LOAN REPAYMENT PROGRAM
  ACCOUNT.  The physician education loan repayment program account is
  an account in the general revenue fund.  Money in that account may
  be appropriated only for the physician education loan repayment
  program under this subchapter.  Interest or other earnings on the
  balance of the account shall be credited to the account.  Section
  403.095, Government Code, does not apply to the account created
  under this section.
         SECTION 4.  The change in law made by this Act in amending
  Section 153.053, Occupations Code, applies only to the issuance or
  renewal of a registration permit the application for which is filed
  with the Texas Medical Board on or after the effective date of this
  Act. The issuance or renewal of a registration permit the
  application for which is filed with the Texas Medical Board before
  the effective date of this Act is governed by the law in effect when
  the application is filed, and the former law is continued in effect
  for that purpose.
         SECTION 5.  This Act takes effect September 1, 2009.
