A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to written notice to parents of certain amendments to |
|
school district student codes of conduct. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 37.001(d), Education Code, is amended to |
|
read as follows: |
|
(d) Each school year, a school district shall provide |
|
parents notice of and information regarding the student code of |
|
conduct. As part of or in addition to the annual notice, the |
|
district shall provide parents written notice and information |
|
regarding any change or amendment to the student code of conduct as |
|
soon as practicable after the change or amendment is adopted if the |
|
change or amendment could result in: |
|
(1) a student's suspension from school, removal from |
|
class and placement in a disciplinary alternative education center, |
|
or expulsion under this chapter; |
|
(2) a finding under Section 54.03, Family Code, that |
|
the student has engaged in conduct indicating a need for |
|
supervision; or |
|
(3) the imposition of a criminal penalty. |
|
SECTION 2. This Act applies beginning with the 2009-2010 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
