A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to minimum liability insurance coverage amounts for |
|
|
persons convicted of offenses related to the operation of a motor |
|
|
vehicle while intoxicated. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 601.072, Transportation Code, is amended |
|
|
by adding Subsections (a-2) and (a-3) to read as follows: |
|
|
(a-2) A person convicted of an offense relating to the |
|
|
operating of a motor vehicle while intoxicated must maintain, in |
|
|
addition to the minimum coverage required by this section, |
|
|
additional liability insurance coverage to establish financial |
|
|
responsibility under this chapter. The amount of liability |
|
|
coverage required increases by $25,000 for each conviction. |
|
|
(a-3) In this section, "offense relating to the operating of |
|
|
a motor vehicle while intoxicated" has the meaning assigned by |
|
|
Section 49.09, Penal Code. |
|
|
SECTION 2. Section 601.072, Transportation Code, as amended |
|
|
by this Act, applies only to an offense committed on or after the |
|
|
effective date of this Act. An offense committed before the |
|
|
effective date of this Act is governed by the law in effect |
|
|
immediately before that date, and the former law is continued in |
|
|
effect for that purpose. For purposes of this section, an offense |
|
|
was committed before the effective date of this Act if any element |
|
|
of the offense occurred before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
