A BILL TO BE ENTITLED
 
AN ACT
  relating to the rate charged for electric service by a provider of
  last resort.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.106(b), Utilities Code, is amended to
  read as follows:
         (b)  A provider of last resort shall offer a standard retail
  service package for each class of customers designated by the
  commission at a fixed[, nondiscountable] rate. The price of
  service under the standard package:
               (1)  may not exceed the average price for electricity
  in the service area served by the provider of last resort; and
               (2)  applies for a period of 60 days before it may be
  adjusted to account for changes to the average price of electricity
  in the service area served by the provider of last resort [approved
  by the commission].
         SECTION 2.  This Act takes effect September 1, 2009.
