A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the rate charged for electric service by a provider of |
|
|
last resort. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.106(b), Utilities Code, is amended to |
|
|
read as follows: |
|
|
(b) A provider of last resort shall offer a standard retail |
|
|
service package for each class of customers designated by the |
|
|
commission at a fixed[, nondiscountable] rate. The price of |
|
|
service under the standard package: |
|
|
(1) may not exceed the average price for electricity |
|
|
in the service area served by the provider of last resort; and |
|
|
(2) applies for a period of 60 days before it may be |
|
|
adjusted to account for changes to the average price of electricity |
|
|
in the service area served by the provider of last resort [approved
|
|
|
by the commission]. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
