A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to reporting certain information on the Internet relating |
|
|
to cases heard by administrative law judges employed by the State |
|
|
Office of Administrative Hearings. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 2003, Government Code, is |
|
|
amended by adding Section 2003.058 to read as follows: |
|
|
Sec. 2003.058. INTERNET REPORT. (a) The office shall post |
|
|
on the office's Internet website at least once each quarter a report |
|
|
on the total number of cases heard by each administrative law judge |
|
|
employed by the office during the previous quarter. |
|
|
(b) A report must be posted not later than the 30th day after |
|
|
the last day of the quarter and must include: |
|
|
(1) the name of each administrative law judge; |
|
|
(2) the number of cases heard by the administrative |
|
|
law judge during the quarter; |
|
|
(3) the municipality, county, or region in which the |
|
|
hearing was conducted or the final ruling was made; |
|
|
(4) the category the office assigned to each case; |
|
|
(5) the number of cases in which the administrative |
|
|
law judge's decision was favorable to the state; and |
|
|
(6) the number of cases in which the administrative |
|
|
law judge's decision in favor of the state was appealed to the |
|
|
courts and upheld by the reviewing court. |
|
|
(c) Each administrative law judge employed by the office |
|
|
shall provide the information required under this section to the |
|
|
office not later than the 10th day after the last day of each |
|
|
quarter. |

|
SECTION 2. This Act takes effect September 1, 2009. |
